1. Nature of Service

PubGo is an AI-powered research tool designed to assist academic and medical researchers in identifying potential journals for publication.

IMPORTANT DISCLAIMER: PubGo is a decision-support tool only.

• We do not guarantee acceptance by any journal.
• We do not provide medical advice, diagnosis, or treatment.
• We are not affiliated with any specific journal or publisher unless explicitly stated.
• Usage of the Service does not constitute an editorial or peer-review service.

2. User Responsibilities & Acceptable Use

2.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

2.2 Prohibited Data (No PHI/PII)

You represent and warrant that you will NOT upload, submit, or transmit any:

• Protected Health Information (PHI) as defined under HIPAA or similar regulations.
• Personally Identifiable Information (PII) of patients or study participants.
• Confidential data that you do not have the right to disclose.

Any abstracts or texts submitted to the Service must be fully anonymized and de-identified prior to submission. We reserve the right to immediately terminate the accounts of users found to be uploading sensitive patient data.

2.3 Prohibited Activities

You agree not to:

• Reverse engineer, decompile, or disassemble any aspect of the Service.
• Use the Service to train competing machine learning models.
• Scrape, spider, or crawl the Service without our express written permission.
• Use the Service for any illegal or unauthorized purpose.

3. Intellectual Property Rights

Our IP: The Service, including its algorithms, software, designs, and branding, is the exclusive property of PubGo and its licensors.

Your IP: You retain all ownership rights to the abstracts, manuscripts, and content you submit to the Service ("User Content"). By submitting User Content, you grant PubGo a limited, non-exclusive license to process, analyze, and store such content solely for the purpose of providing the Service to you and improving our internal models (unless you have opted out of data usage for training).

4. Payment and Subscriptions

Certain features of the Service may require payment. We use third-party payment processors (e.g., Stripe) to bill you.

• Subscription Terms: Subscriptions renew automatically until cancelled.
• Cancellation: You may cancel your subscription at any time via your account settings. Access will continue until the end of the current billing period.
• Refunds: All fees are non-refundable generally. Refunds are granted solely at our discretion or where required by law.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUBGO EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE READINESS, ACCURACY, OR QUALITY OF THE RECOMMENDATIONS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PUBGO, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, OR FOR ANY CLAIMS REGARDING REJECTION OF MANUSCRIPTS OR ACADEMIC MISCONDUCT, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO PUBGO IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) FIFTY US DOLLARS ($50).

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Tel Aviv, Israel, and the parties hereby consent to the personal jurisdiction and venue therein.

8. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
